Getting Tired of the BS!!! What would you do?

I am getting tired of the BS!!!!!!!!:mad: Everytime I get on Ebay I see MY pictures of MY LS selling body-kits. I didn't give anyone permission to use my pictures or my car. Razzi and LSKoncepts are the only companies that has permission to use my car in there ads.

I spoke to a lawyer about going after these companies. He suggested registering the pictures that these companies are using and go after them.

What would you do? Be flattered that a company is using your ride and let it go. Or go after them. After all, its my car and my work. Why should they reep the rewards and fruit of MY labor.

What do you think?
 
Get used to it by now? Or spend a ton on a lawyer to go after them.

I'd probably say "whatever", but that's just me.
 
For me it would depend on the lawyer fees and registration fees. I'm assuming it'll cost a decent amount, so I'd say whatever. Maybe you can send a message to the sellers asking them to remove the picture or ask for permission?
 
go after them if the cost isn't going to be huge
if the lawyer is going to charge allot then just
email the companies and tell them to take if off or
you will have a lawyer contact them or something to
scary them and if they still don't take off the images
try finding a cheaper lawyer​

I have been seeing it all over Ebay and the internet and figured you were making a killing off of it.... go after these theifing bastards!!

Quik has been used many times as well - even by other members of some of the forums I'm on. Frankly, once I post pictures on the internet - I consider them public - like you, I'm on a bunch of boards/forums.

it is flattering - and unlike music or art - they are not stealing royalities from you. They are using your pic to help them make money without your permission - but it's not like they 'stoled' the pic.
 
Ask for royalties, if they say no, then just let it go. Take it as a compliment.

I mean :q:q:q:q FORD motor company tried suing every MUSTANG and FORD etc forum for using there names... even though they weren't making any money off of it...

The Ebay auctions are easy to shut down. Ebay takes image stealing a serious matter. All I have to do is report each one.

That will not stop them from using in other places. I could copyright the pictures. If they use them then, they are deep crap. Thier stuff will become my stuff. Copyright stealing is a serious issue.

The lawyer I spoke to suggested that I approach each company. Tell them to pay me a usage fee for the pictures, remove the pictures, or be taken to court. Which they will lose.

I guess I will start contacting each company. Type up a real nice e-mail and send it out. I still would like to konw who took the pictures and photoshopped them in the first place.

I wish I was making a killing. If you could, let me know of any other places you see the pictures besides Ebay. I am starting a list of who is using them. They can pay me for the use of my picture or my car. Thanks.:)
 
I would make one of them give you a new kit.. and then find someone local to resell that kit to:rolleyes:
 
i'm sure they got them from a public site. unless they went to your neighborhood and snapped some pics then i would start with the lawyers. if you put the pics up on forums and different websites you are allowing them to copy them, and it was because you initially posted them in a public place, THE INTERNET!.
 
Didnt this happen before and you asked what to do?

Pretty simple, watermark your pictures. It might ruin them a bit but then it's plain and clear who owns them. Unless the images are copyrighted they can use them as much as they want. Once you put them on the internet and they are uncopyrighted or watermarked or show that the photos are owned by you, they can use them as they see fit. The car might be yours, but the images arent unless you stake your claim to them.
 
I found out Extreme Deminsions has been giving all of there dealers the pictures. I had been in contact with ED about working something. I hestitated and never signed the deal. I am glad I didn't. Figure, they have made thousands off my car selling there kit. Its time they take of me over the matter. I contacted ED about the issue. Hopefully, we can reach an agreement. If not, i will force them to remove all the pictures. Including all the pictures they handed out to there dealers.
 
Damn...good work. Hopefully they hook you up with some cash as a sort of pre-litigation settlement. This has become an increasingly popular problem with the growing popularity of facebook and myspace. There are tons of advertisements done overseas using people myspace/facebook pictures that people will never know about. Your pictures are not THEIR pictures and hopefully you are rightfully compensated for this BS.

Your legal settlement should include a clause for like 50 free kits for your fellow ls'ers

As your lawyer I advise you to do this in regards to this manner.
 
What your intending to get involved in is way over your head. Your dealing with copyright and licensing issues and the use of "your" pictures. First off, any picture can be submitted online for copyright...pay $35...done deal. Its also not retroactive, all the people using the pictures currently can still do so until YOU provide proof of copyright, it is then after you provide proof and ask for them not to be used that they would have to cease using the pictures or face potential litigation. Even then, they are personal photos and would never win a judgement. You'd have to prove damages, and you have no damages except to your ego. Maybe if you had your own licensed business and were using the photo's then you might be able to prove some form of damage. Use of a picture of your car that you posted online is NEVER going to win you a penny. Another form of damages awarded from the use of a picture would be a professional photographer such as a wedding photographer who makes money off of the photo, you are not making money off your pictures. The most you would ever get out of this would be these websites to stop using your pictures. You would have to retain a lawyer and its going to end up costing you alot just to keep people from using the photo. I dealt with this when i handled a merchandise catalog for a company that i used to work for. Bottomline, get over it.
 
Extreme Deminsions and I spoke this evening. We reach a settlement for use of the pictures. In the agreement, I will recieve merchandise(no money). In turn, I will provide them with BETTER pictures. I hate the pictures they are using. They actually are excited over the fact that they will be getting better pictures of the body-kit and car.


Fla02LS. Those are my pictures and its my car. They knew it and settle VERY quickly. If had to pursue this more, a lawyer would have been taking care of the issue. I took the advice of the copywrite lawyer I spoke to. I went after them aggressively knowing I had a case. They wanted to do the right thing and settle it quickly. Both sides got what they wanted. issue is settled.:)

Funny thing. You would have figured such a large company would be moving product. The LS body kit isn't a money maker for them. So I didn't get as much as you would figure.

I dont see you having a case at all unless the pictures are copyrighted. You dont even need to put "copyright" in the picture, they can still be copyrighted.

I can see Extreme Dimensions backing down to save them a few thousand in lawyer's fees if you were to go after them but they would've won because there is no case there.

You haven't answered my question as to what pretense your lawyer said you have a case.

I happy for you that they backed down though. I do think what they are doing is BS but I really do think the law is on their side until you start copyrighting or watermarking your photos.
 
+1 - you didn't get a settlement - you have a new go forward deal for pics, it was probably the easiest and right thing to do.
