as it states, its a real tiny nick on one the of teeth. I doubt it makes any difference but i'm curious.
small nick on 4.10 pinion tooth, is this a problem - pic inside :-)

I wouldnt think that would be a problem. I dont know much about rear ends but I work with gears every day and most of the time they dont auctually use the whole surface to run on so you should be ok.

that part of the gear will never be used by the ring. That being said....the amount of labor to install and set up the R&P should be taken into account when looking at the gear. If that gear was hit hard enough to chip it can be a "weak" spot and should not be used. Yes I know it is only a small chip but the labor...... If that was purchased from me I would replace the set for you rather than let you install it and have a problem down the road.
That is my opinon as a new car dealer, and would not give that gear set to a tech for install. Safe than sorry I always say.

As a former rearend rebuilder in big trucks, I would not hesitate to use that gear. I would however have it checked, magnafluxed, sonic tested, or whatever other method they are using today. I would also dress that nick with a small grinder to eliminate any stress risers occurring in that area. As Max said, you will not even use that part of the gear. But I do see his point. We used gears that were nicked harder than that in big trucks that went well over 1/2 million miles without failure.

Plus if you assemble the axle and it does break, the whole axle is now contaminated meaning new bearings all the way around, and everything must be cleaned out spotless. Can you run 90w in a mark LS rear end? or do you need the stupid friction modifier and goofy weight oil also?

You bought the kit new right? Why take a chance? Send it back and get them to send you a new pinion. You bought a precision part, it should come in perfect condition. I mean, although the chip is small, it got there somehow. (from being dropped or whatever) Make it their problem, not yours. 
Ok, i just read in your other post that you got it off ebay, not sure what the deal is in that case. If you can't send it back then just ask the opinion of whoever is doing the install. Probably be ok.

multiple people told me it won't be a problem...
