so today i started moving stuff to our new house, my wife took the mark to my parents for a bit with my daughter for some art project my mom and daughter are working on for christmas, skip ahead a few hours my wife is on her way home and she gets stuck behind a dumpster roll off truck carrying a full uncovered load of drywall and wood, a half a sheet of drywall blows out of the back of the truck and smashes right down on the nose of my lincoln, she couldnt avoid it due to cars on both sides of her, so she gets up on the side of the truck to stop the guy, laying on the horn waving at him to put the window down, he's on his cell phone, what a suprise, he looks at her and keeps on going, she got the number of the truck and the company and phone number to give to me. so i see the damage, bumper is scratched real good, both headlights are busted, both marker lights are busted and the corner of the hood is cracked. i call the office and tell the lady the whole story, she is in disgust with the driver, i told her where it happened and she knew the truck before i even spoke one number off it to her, almost like the driver may have had problems already. she gives me her email address and tells me to take photos of the damage and tell her what is broken, then she forwarded it to their insurance dept and they called me right back, they told me to take it tomorrow and get an estimate for repairs, and they will take care of it right away with a check, no questions asked, i have 72 hours to fill out a police report, so i am holding off doing this until i see what they have to say about the estimate, if they try to screw me, i'll make a trip to the police dept. we'll see how this B.S goes, i dont think they are going to like the estimate for new front lights, maybe some dumb ass driver will lose his job. there is still drywall jammed in between the headlights and hood, i had to shove some cardboard under the right light to keep it someone aimed up, what a joke.

I would be happy too (I know you are being sarcastic)!! New headlights!!!!!!!!!! Well, better. I am guessing it will go your way, it usually does.

That hood looks damaged on the corner too...

they are, they dont want their insurance to go up, which is fine, i want a check, i'll fix it myself and pocket the rest, if i fill out a report, then when i do get it fixed the check will go to the collision shop and not me.

I was driving my moms caravan, when it was new, got stuck behind a dump truck all the sudden I found my windshield covered in gravel. Why can't this happen to my lincoln, free paint job LOL :D

Jamie, good news is in there amongst the bad. You're moving to a new house.... Your wife and daughter are safe.... and if all works as outlined, your Mark will be even newer. Good luck and keep us posted with the outcome. Gary.

I bet with the current price of Mark VIII's they are going to try to total it since it would be cheaper.

When i was stationed in Tenn. I had a accident like that, the driver said he woujld take care of it. After a few day of not hearing from him I filed a police report, and the officer threatned to ticket me, because it is against the law to have an accident and not report it. so be careful

The good news is your wife and daughter are ok and you'll all enjoy X-Mas in your new house. (Nice X-Mas gift to yourself) Now for bad... that's not a good spot to get a crumple as I'm sure you are well aware of. I hope the trucks insurance company will foot the bill for you.

It is in no way against the law to be involved in an unreported accident, unless you were the cause of said accident (hit and run.)

Anyway, whenever you're involved in an accident, call your local non-emergency number (or obviously call 911 if someone's injured,) and a Police Service Aide (or officer, if you live where officers get bored enough to report accidents themselves) will come and take a report. The action of having filing a report is NOT the same as filing an insurance claim

I had a girl run into my Crown Vic several months ago, a PSA came out and filed a report - before I filed an insurance claim against the girl, she offered to pay for the damages. I went to a body shop, got an estimate, and sent her a copy. Surprisingly enough, she came through with a legit cashiers check to cover most of the damages, and I never went through with the insurance claim. So she was out $600 (estimate was $900,) I fixed the damage myself for $80, and she didn't have to pay out the nose for insurance for the next 3 years. However, if she hadn't come through with the money, I was free to proceed with the insurance claim. Everyone was happy. Except that I didn't get a date with the very attractive PSA though (PSA's are 18-21 here, so everything would've been legal,) I'm trying to get run into every chance I get to see her again... :D

its far from totalled, it needs the corner of the hood fixed, they want to repaint the bumper cover which i wont bother with, and replace the front plate bracket, the head lights and marker lights, got the estimate this morning $1,382.16 obviously i want the check and i will fix it myself, unless i have to go to the police today if they dont call me back within a few hours then i am going to get nasty about it, i had her promise that she would take care of it so i'm giving her half a day, then i go to the police and take it from there. i already have another set of headlights so thats all set, i just need marker lights and i'll buff the rest out and leave it, its almost 16 years old i dont want any paint work done to it because then the car will look stupid, i can live with scratches and matching paint, i dont want a piece of the car to look mint when the rest shows its age.

Not true.
Check your local laws.

State of Minn.
Every driver in a crash involving $1,000 or more in property damage, or injury or death, MUST COMPLETE this form and send it to Driver and Vehicle Services within 10 days.
Failure to provide this information is a misdemeanor under Minnesota Statute 169.09, subdivision 7. See reverse side for address and for data privacy information.

clicky

That sucks Jamie.
Get every penney you can out of them.

got the check already, $1,382.16 is what the amount was. the check is sitting at ford in the collision office waiting for me to go over and pick up the headlights and marker lights and deposit the left over $992.16. merry christmas!!!!

Sorry, I should have put that asterisk in there...

Regardless, what I mean is that there's not going to be any follow up on that, even in the places where similar laws exist. They won't prosecute you for getting run into and going home. Any such law pretty much applies to some kind of wreck where after being hit your car runs into someones house, another car, etc. I'm not sure if the $1k in property damage would even apply to your vehicle in this case, an argument could probably be made that it doesn't.

all's well that ends well-most important, your wife and daughter are Ok, and if anyone here can make it whole again, it's you-the money left over will just cover the agg, though

Yes they can follow up on it.
And yes they can charge you with a misdemeanor.
Your car is property. If it has $1,000 in damage they want you to report it.
If you trade paint with somebody in this state and you both decide not to report it, then the person you traded paint with changes his mind and reports it, and you don't.
You will be charged with a misdemeanor.
You don't have a clue what your talking about.

Like I said check you local laws.

ford nut, no one traded paint with my car though, the car was hit with flying debris out of a dumpster, no one hit my car, no one went off the road, it wasnt a motor vehicle accident so no need for everyone to start a fight about who's law is what.

Don't mean to start a fight just saying what the facts are.

I would check my local laws thats all.
Trading paint or having a hunk of sheet rock blast into your car dosen't matter.
It is still property damage.
They put these laws in for a reason.
They want you to report these type of things in Minn. so they can keep track of drivers.
Who knows how many time this dope has done this.
I am Just glad nobody was hurt.

me and a buddy were coming home from florida in january in his lexus...

were making great time ... we hit Maryland and we are behind an SUV..

FREAKIN HUGE sheet of ice comes flying off the hood of the SUV.. and is flipping through the air... and SMMAASSHH !!

it hits the hood and smashes the entire windshield... and came halfway into the car...

rearview mirror was in the backseat.. and its hardwired to the glass !!

it literally almost decapitated both of us... i grab the guys plate number and make /model car..

we call 911.. state police show up...they say ..and i quote

" we cant do a thing about it.. its your word against his..call your insurance company to fix it"

WTF !!

anyway.. ins. co. asks for plate and all info... turns out plate was stolen

and he had to pay all damages out of his own pocket !!! (1000 deductible.. damage was 950)

consider yourself lucky ...
