Supposedly the guy that won the auction for the CE got in a car accident today and is in the hospital in critical condition. A colleague of his called me tonight

At this point I dont know if its legit, smells kind of fishy to me.

Im really just worried about the $500 deposit required within 48 hours of the end of the auction that ended Saturday that hasn't been paid.

How should I proceed?

I already sent out a couple second chance offers but I doubt there will be anything that comes of it.

Not only am I out the listing fee, but since he did technically win I have to pay the $125 successful listing fee also.

how come I keep getting screwed!?!?!

doesnt mater if he is in the hospital a contract is a contract and with that
ebay should help you out

Ebay won't do d1ck, they are geared towards buyers now. Their "legally binding contract" really isn't. The only thing he will be able to do is report the deadbeat bidder to Ebay and relist the auction, hopefully getting a refund of the auction fees.

tell ebay he hasnt paid the deposit or contacted you and tell them that b.s story if the car doesnt get paid for that means you didnt sell it and you shouldnt have to pay the selling fee.

yeah I got refunded when a guy won my Tag Heuer watch and did'nt pay for it! I got ebay on the live chat and they refunded all of the charges I incurred on my pay pal account!

even if he paid it entirely, you can still file an unpaid dispute and get your listing fees back

there are a few options, pick what fits your situation best, if you choose that you have both agreed to cancel the transaction or that he won the auction in error you will receive your money back and he will not get a negative strike

also, if you are trying to see if he is really in hospital search his local news online for accident reports.

Did the colleague say anything about if he wanted the car still?

sounds like he is pulling your pud on this one! Just like jamie and the other guys said....contact ebay and tell them he is a deadbeat bidder and they may work with you. I have had the same crap happen to me too...it blows:mad: Good luck
