Biden and Obama failed to be sworn in by 12:00 noon. Therefore, with Bush and Cheney's tenure over at 11:59:59, Secretary of State Condi Rice was acting President. Why not Nancy Piglosi you say. She was still acting Speaker and therefore not eligible until she resigned her post.

According to the 20th Amendment to the U.S. Constitution, the terms of the President and Vice President end at noon on January 20th, and the terms of their successors begin at that same moment. Therefore, George W. Bush ceased being president at precisely noon, and Barack Obama became president at noon.

U.S. Constitution, Article II, Section 1.8 prescribes that the President shall take the oath "before he enter on the execution of his office," but this is prescriptive, not prohibitive.

No, She would have had to resign her post first. In this instance, at that moment, Condi was acting President. Just the way it is. Obama had to have been sworn in BEFORE 12:00 noon.

And for the record, I do not hate Obama. But I do disagree with almost everything he believes and I won't forgive him for his past associations. Those associations made him what he is today. The worst person for America at this time on our history. We do not need to be a socialist nation. Becoming one will only make things worse, not better.

Are there going to be any business guys that are going to be willing to take the risk knowing that their rewards are going to go to the "common good". I don't know of any.
