Lemon??? (PLEASE HELP!!!!)

I bought my 2002 LS in June of 2005 with 32k miles. I am currently at 48500 miles.

I have the following warranties:

manufacturers 4 year 50k miles (expires Oct 06)

qualitycare maintenance 4 year 61k miles (expires Oct 06)

premium care maintenance 5 year 75 miles (expires Oct 07)



Starting in Sept 2005 I began having intermitent starting problems. I have brought the car in to the local Lincoln dealership(not where i bought it) 5 TIMES now for the same starting problem, and the problem showed up again today.

Today(6 days after they "fixed it" for the 5th time), I went to start the car and the car did not start. I turned the key about 20 times, and the car finally started. I as far as I am concerned, they did not fix the problem.

I love my car, but I am really getting fed up with it. I want to be able to walk out to my car and know that it is going to start! I have been reading about California Lemon laws, and they state that car is a lemon if the dealership can not fix the problem in 4 attempts, so I my car should qualify as a lemon.

I really like my car, but it is becoming a really pain in the a$$. what should i do:

- try to get the car to qualify as a lemon and get most of my $ back(which may be a paper work nightmare)?

- bring it back to local dealership(not where i bough it) and allow them to try and fix it for the 6th time

- contact the Pontiac dealership(50 miles away) that I bought it from and see what they can do for me

- contact Ford dealership(50 miles away) that original owner bought from and who the extendend warranties are through and see what they can do for me

- contact Ford and see what they can do

- try and trade it in and get a lesser car

- other

Obviously taking it back to them a 6th 7th 8th time if necessary is what you have to do, otherwise you'll have a 3,700 lb paperweight. I think the lemon law only pertains to brand new vehicles, not used. You buy used your on your own pretty much. Your only probable angle is to keep in contact with Corporate Lincoln and your local FLM dealer. The Pontiac dealer isnt going to do jack for you, once you pulled off their lot its no longer their problem. Most likely whatever is being fixed may not be the issue. Plus if the dealer does a repair and it fails again after the car's warranty expires you should still have a warranty on the actual repair/parts.

i drove my LS around town today, and decided that i like this car too much to get rid of it. i will just continue to bring it to the dealership.

so i installed some 5x7 infinity components today. they sound GREAT, and yes they are conected to the stock amp. i am thinking about getting another set for the rear now.

California does have "lemon law"-like protections that pertain to used cars. Do a search; I posted an excerpt from a California gov't Web site here a few months ago. It also had the URL for the Web site in question.

You'd be surprised at the response you can get if you go the Corporate route. Tell them your gonna get your attorney involved, contact BBB, go to your local news....something. The fact that it is still under warranty means they are gonna foot the bill for the repairs, they shouldnt want to keep putting money into it. Make them look like the fools. No company wants bad publicity. Maybe take it to a different FLM dealer to be inspected. But definately call Lincoln directly. My wife recently took a trip to Chicago and complained about the bathroom on the plane because it was nasty. I got people from Delta now calling all the time. Most of the time the higher ups want things to go smoothly.

The names of the warranties you describe are Ford ESP warranty names, so you should be able to take your car to any FLM dealership and get service. If your local dealership isn't getting the job done, take it to another dealership and see if you can get better results. There are several Cali guys hanging out around here; surely one of them can point you at a dealership in your area with a good service department.

PLEASE HELP

If I remember correctly, Ford offers a warranty on the work they provide......either on the parts, labor, or both. Also, what did they fix on the car the previous 5 times? I know there is a TSB out there for lack of fuel pressure when starting the car.......something about a cracked fuel line clamp or something. Maybe someone else will chime in here.
