fail emissions for CEL for transmission issue?

So as always, car is due for emissions test, and for the last 11 months and 2 weeks, no CEL, and all monitors passed (even Evap, which I squeaked by last emission test with it not being complete yet, but not failing). CEL is on starting this morning, codes are p0705 and p0708. I know I need to replace the TRS/neutral safety switch, but will it fail emissions test with these codes? The CEL is on, and there are no pending or stored coded other than the two for the TRS. I fixed the "check transmission" blinking OD light which was for the TFT over temp, but that never set the CEL.

I hate driving it with the TRS having issues because I can't manually select second, and the beeping error in the message center, but I want to get a decent one, and for some reason I don't think the one from my 97 Cougar will work, as it is the same as the 96 Mark VIII.
 
I imagine it depends entirely on your state's policy. I don't live in an emissions state anymore but when I did, it was the state that did them. I know in some states the government contracts out the work to private shops, I have no experience with that. In the case of when the state itself does it, in the vast majority of cases, they are not car people, they're bureaucrats with an OBD scan tool or a sniffer to shove up your car's tailpipe if it's 1995 or older. If the CEL is on, you fail. They don't know anything beyond that. That's how it was in NJ.
 
If the CEL light is on it is an automatic failure. This is based on it being 1996 or newer. Code description or type is insignificant.
 
I drowned the MLPS with brake cleaner and things were good, until the very day I take it for emissions testing. The one I ordered online was the older style, and yes, as expected, even with a non emissions code it failed.
