I learned this a long time ago, when I just got my license... 1985. If you hit someone or someone hits you, go thru the insurance company. I was just out of high school, when I ran into the back of someones cadillac. We went to the guys house, and my father told him to get an estimate. OF course they came back with some rediculous amount. They went thru the insurance instead. People will always try to screw you. People suck.

F him if he is trying to screw you. you already gave him 200, if there is no damage to his truck tell him to screw..

Here, I will help. USE PUNCTUATION SO I KNOW WHAT THE FOCK YOU ARE SAYING!!!

OK, so she was driving your Mark and hit a truck? First off I would kick her ass and make her pay it all. How bad is the Mark?

Also what is the real dammage to his truck? Dont say nothing cause any impact will hurt something. If she bent his bumper then thats a $1500+ repair on any newish truck.
Dont try and screw the guy when he was just being nice and keeping your drunk GF out of jail. Hell, her fine would be more then $1500 and thats not counting bail and her record.

Do you have some pics of the dammage? Take some pics and post them, maybe his $1500 request is spot on. MAYBE he has a friend that will fix it for $1500 where as a shop would want $4000.

Need more info.

Well here is another issue ... Not reported to the police ... guy says you hit him and fled. Unless you wrote him a check and have evidence that you did deal with the problem. Otherwise you fled the scene of a crime aka hit and run. His word vs yours. His car damaged yours did the damage.

Personally I think you are screwed and are going to have to pay this guy $1500. Either you or your GF ... Sorry I can't give you a better solution.

Also I got side swiped buy a guy this summer while my car was parked infront of my house. Surface scratches but hit all 3 panels front, door, and rear plus put a smudge on the mirror. Price to get repaired $1500.

I took a buffer to the scratches and what was left was the smudge on the mirror which I fixed for a few $1.00s ...

So ...

I'm a professional body man...IF he has a copy of an estimate that he can give you. email me a copy and I'll take a look at it. I'll let you know if he's trying to take you to the cleaners of if he's in line. Also if you have some pic of his truck it would help. my email is ibboonie81@hotmail.com

No! she was not driving my mark she was driving my truck and hit like an 2002 impala. Put a couple scuffs on the bumper of my truck but they rubbed right off. She hit his rear above the back wheel, but he said there was some damage there already. It was dark so not sure how bad it really is.

if she has damaged his 1/4 panel very bad then 1500 is prob a close estimate. It takes a little to straighten 1/4's and you have to paint around to the windshield post. Also, depending on the color, the door will probably need to be blended as well.

She hit a newer GM with a truck? If it hit the side of the car anywhere then $1500 is prolly on the lite side. Go through the insurance and then take her keys away.

if your insurance insn't valid, he has saved you alot of money in tickets and a record. A non valid insurance ticket here in IL is at least $700. I would pay him. Sucks but thats life.

He said he went to mayco but i haven't seen the estimates yet and i don't know how much damage was already there and how much damage the truck did to it. I mean it didn't hurt the truck at all so most of it might have been there already.

He settled for 200.00 bucks right there on the side of the road tell him to eat it. Especially if there was previous damage.

Sounds to me like he doesn't have a license or insurance or something. Cause I would have had the cops involved immediately, unless I was hiding something.

Many years ago in my Merc I slid into the rear end of a Neon that some chick had slammed the brakes on in front of me for no reason. I lightly hit her and only put two 'lil holes from my emblems in her bumper cover. I told her I'd pay the damage to avoid an insurance claim for both of us (no fault up here.) She agreed and I told her to get a few quotes. The middle quotes was about $600 so we went with that and I found out later her relatives own the body shop! She walked away happy from that I'm sure... She also had written off 5 cars in past two years! lol... Not much I could do but pay...

Daviddc114

yea man, if you hit his rear quarter than you are probly screwed.. i agree its wierd he didnt want the cops there, eaither he is really nice, or he just wants to pocket the cash. either way, you are screwed. 1500 sounds fair to me for rear quarter damage. that is unfortunatly the WORST place to have damage, that and the B pillar..

You can call the cops. She's not drunk now, so they would have to prove that she was drunk at the time. Then it still becomes his word to yours but at least she wont go to jail and you wont have to pay him.

Cops will not do anything now, they would want to know why he did not call at the time of the accident. At this point it is word against word, and the lack of damage to the truck would go to support your side rather than his.

this is why i would have called the cops. It never does any good to be nice these days. You hit his car, you didn't have insurance, you were drunk. You gave him 200 and now screw him on a 1500 estimate? He's saved you that in tickets and court cost.

Anything less than $5000 goes to small claims court...you think he wants to hire a lawyer..waste his time, and then you don't show up to court anyway, if there's no police report within "x" number of days (check
your state laws) then there is usually no grounds for suit...also check court appeals,
all this information is available to you at your local public library, in the legal section...
Nobody that I know of on this site is a board certified attorney...do some research before you make your decision

I agree. Anyone who does not want me to call the cops is going to get the cops called. I had a guy who hit me back in 1994 beg and plead for me not to call the cops. I did anyway and found out he had no license or insurance. Luckily my insurance paid and went after him later. I was told if I had not called the cops they would not have paid under uninsured motorist coverage and I would have been responsible for the damage.

Leaving the Scene of an Accident Involving only Property Damage - Penalties

If you are involved in an accident that results in damage to a vehicle or other property, you are required by Kansas law to stop and exchange information with the other driver. Failing to do so can get you charged with a Class C misdemeanor which carries a potential sentence of one month in jail and up to $500.

But.....

He took $200. (You have the witness) There is no down payment on damages while information is being exchanged. I'd buff away your damages completely and turn it into a he said, she said. If something is brought up about it, he said $200 would cover it because he already had previous damages. I have no faith in the system anymore ever since I got a ticket for having "legal" window tint and a ticket for not having a tint compliance sticker (not in my job description) and had to pay $100 on each ticket. Don't think about the guy that was hit. If the system doesn't have any way to get money, then you have nothing to worry about. You exchanged information and you paid cash on the spot. Case closed!

silver94
August 24th, 2010, 03:42 PM
Ya but he has my address so I think i will agree to pay half. Just because i don't want him coming to my house and fu**ing up my car. Thats only fair i guess because i have no idea how much damage was already there. So i will not pay to fix all of it when he already had damage done to it before.
