Wow thats interesting. My house almost got broken into 2 years ago right after we moved in.Its a small house with a big yard across the street from the quietest projects in the city, no crime, nothing too bad, just subsidized housing. I woke up to the sound of my screen being pushed up. My 2 windows were surrounded as well as my mothers. This was not fun. I had my bb gun close by on a magazine rack and shot a full clip out the window through the blind and ran outside to see 5 guys hopping my fence.

The next day we adopted a dog, never had a problem since.

You are damn right its not safe. I would have beaten them with something. They obviously did this knowing that since they are the Police they can get away with it. There had to be a great chance of someone else thinking the way I would then what would they do? Use excessive force.

I'm not one for conspiracy theories or the theorists that make them but that indeed is a invasion of ones property and could very well have lead to something some may have felt dehumanizing.

I know I would have been royally pissed if I was sleeping in my birthday suit seeing how you should be allowed to enjoy those comforts of your own home.

How are they no subject to prosecution under the penalties of illegal entry and unlawful trespass?

I would press charges against them for trespassing and unlawful entry. It would never stick, but if you make a big enough stink about something like this, maybe they would get a scold or something from their superior officers. That really is unbeleivable though. What if, in the semi-conscious state many people are in at 3am, he just saw 2 armed men in his house and shot them? Then all of a sudden someone who reacted to protect the 4 children in the house would now be prosecuted as a cop-killer! I've never been a fan of police, but if you acknowledge the need for them, then you also have to hold them to a higher standard than your average person, and this is not only an invasion of his privacy and totally uncalled for, but it is also recklessly irresponsible if you ask me.

So the police came upon a house.
It was late at night.
The garage door was open.
The keys were still in the car.
The door was left ajar.
And no one responded after they repeatedly knocked on the door.

Should they have investigated it?

It also sounds like the police engaged the children early on. They weren't sneaking around the house.

These cops are damned if they, damned if they don't.
Nothing appears to have been wrong this time, but what if the home owner had been abducted in their car or home? The signs were there. Would we be having this discussion about how the Police FAILED to do their job had that been the case and they walked away, or left a note?

...
With that said, had they been just going around the area, testing for unlocked doors and then walking in, I'd have a totally different response. That note under the door would be a good idea. But this a different situation.

I was under the impression that the cops were just doing a routine thing as part of a 'locked door' campaign and just wondered in! Lol.

In this instance then, they probably should have just shouted loudly to arouse the house owner - or got kids to go wake him up.

You got kids inside then lock your damn doors. Failure to do so is endangering the welfare of a child.

I'll stick with the shouting loudly idea. Whilst i appreciate the Police efforts to protect us, going into a man's bedroom is just, well, wrong! - Might have been naked... or something! Lol.

Possibly... Maybe they did shout but the guy didn't hear because he was a heavy sleeper? Hard to say what really happened without being there.

Still, there was no reason to scare the guy. Once they realized they were sleeping they could have left a note and locked the door behind them. Instead, they chose to flex their muscle and show off how big and bad they were. What if he'd had a gun under his pillow and just reacted? This kind of thing has happened before and people have been shot.
